This hobo is putting himself and others in harm (look up negligence in the CCC) and of course you can't forget this little section (179.2) of the MVABC: A pedestrian must not leave a curb or other place of safety and walk or run into the path of a vehicle that is so close it is impracticable for the driver to yield the right of way.
Of course there is also section 180: When a pedestrian is crossing a highway at a point not in a crosswalk, the pedestrian must yield the right of way to a vehicle.
So no, no one can put themselves or others in harms way and not except a consequence.
Taking a photo, or video, or writing down information of others in public is not illegal and no one can prevent you from committing such acts.
again if you choose to focus on the legalities of the example instead of the issue at hand.. there's not much else i can say as my point was not to dispute whether or not it's in the CC or not...
i'm pretty sure you can't take a photo or video of someone without their consent even if it wasn't your intention to do so.. it might not be a criminal offense per se.. but there's always the option of a civil case (if it escalates to that extent).. while we should respect people's entitlements to snapping pictures and recording videos.. the same should be given to those who don't want to be in pictures/photos of any kind.. =)
